Please read these Terms of Service ("Terms") carefully before using the ProKitchen website at pro-kitchen.shop (the "Site") or placing any order with us. These Terms form a legally binding agreement between you and ProKitchen ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Acceptance of Terms
By creating an account, browsing the Site, or completing a purchase, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have read and understood these Terms and our Privacy Policy, and agree to be legally bound by them.
If you are using the Site on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refer to that entity.
2. Account Registration
You may browse the Site without an account, but placing an order requires either guest checkout or creating an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and not share it with others
- Accept responsibility for all activity that occurs under your account
- Notify us immediately at support@pro-kitchen.shop if you suspect unauthorized use of your account
We reserve the right to suspend or terminate accounts that contain inaccurate information, are used fraudulently, or violate these Terms.
3. Products and Pricing
ProKitchen is an authorized US dealer of ProKitchen and other premium kitchen brands. All products sold through the Site are genuine, new (unless explicitly marked as "open box" or "refurbished"), and come with their full manufacturer warranty.
We make every effort to display accurate product descriptions, images, and pricing. However:
- Colors displayed on your screen may differ from actual product colors due to monitor calibration
- We reserve the right to correct pricing errors at any time
- If a product is listed at an incorrect price due to a typographical or system error, we may cancel orders placed at that price and will notify you before doing so
- Prices are in US dollars and are subject to change without notice
- Availability is not guaranteed; items may sell out between the time you add them to your cart and checkout
4. Payment and Billing
We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, and Google Pay. Payment is due in full at the time of purchase. By submitting an order, you authorize us to charge the provided payment method for the full order amount including applicable taxes and shipping fees.
All transactions are processed through PCI-DSS compliant payment processors. We do not store your full card number. If your payment is declined, we will not process your order and will notify you so you can update your payment information.
For orders above $1,000, we may require additional identity verification before processing.
5. Shipping and Delivery
We ship to all 50 US states and US territories. Standard shipping is free on orders over $250. Expedited and overnight options are available at checkout for an additional fee.
- Standard shipping (FedEx / UPS Ground): 3–5 business days after fulfillment
- Expedited (2-Day): 2 business days after fulfillment
- Overnight: Next business day, if ordered before 1 PM ET
Orders are typically fulfilled within 1–2 business days. You will receive a shipping confirmation email with a tracking number once your order ships. Delivery estimates are not guarantees; delays caused by carriers, weather, or other circumstances beyond our control are not grounds for order cancellation or compensation.
Risk of loss and title pass to you upon delivery to the carrier. If your package arrives visibly damaged, please photograph it before opening and contact us within 48 hours.
6. Returns and Refunds

7. Product Warranty
As an authorized dealer, all products we sell carry the manufacturer's full warranty. ProKitchen products sold through ProKitchen are covered by ProKitchen's standard US warranty (typically 1 year limited warranty on most appliances; select products carry extended warranties). Warranty claims are handled directly through the manufacturer's service network.
ProKitchen does not offer any separate warranty beyond what the manufacturer provides. Warranty coverage does not extend to damage caused by misuse, accident, unauthorized repair, or use outside normal operating conditions.
8. Intellectual Property
All content on the Site — including text, product descriptions, photographs, graphics, logos, icons, and the overall look and feel — is the property of ProKitchen or its content suppliers and is protected by US and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Site content without our prior written consent. For questions about permitted use, contact support@pro-kitchen.shop. See our full IP Policy for more detail.
9. Prohibited Conduct
You agree not to use the Site to:
- Violate any applicable law, regulation, or third-party right
- Submit false, misleading, or fraudulent information or orders
- Attempt to gain unauthorized access to any portion of the Site or its infrastructure
- Use automated tools (bots, scrapers, crawlers) to extract data without our written permission
- Post or transmit any unsolicited promotional content, spam, or malware
- Harass, threaten, or defame ProKitchen staff, other customers, or third parties
- Engage in any activity that disrupts or interferes with the performance of the Site
- Purchase products for resale without prior authorization from us
We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions, including removing accounts, refusing orders, and referring matters to law enforcement.
10. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ProKitchen DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ProKitchen AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ProKitchen IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages, so some of the above limitations may not apply to you.
12. Dispute Resolution
Informal Resolution
Before filing any formal claim, you agree to contact us at support@pro-kitchen.shop and give us 30 days to resolve the dispute informally. Most issues can be resolved this way.
Binding Arbitration
If we cannot resolve a dispute informally, you and ProKitchen agree to resolve it through binding individual arbitration administered by JAMS under its Consumer Arbitration Rules. The arbitration will be conducted in New York, NY (or via video conference by mutual agreement). Each party will bear its own costs unless the arbitrator determines otherwise.
Class Action Waiver
You waive any right to participate in a class action lawsuit or class-wide arbitration against ProKitchen. All claims must be brought on an individual basis.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions. Any claims not subject to arbitration shall be resolved exclusively in the state or federal courts located in Kings County, New York.
13. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will update the "Last updated" date above and notify registered account holders by email. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms. If you object to any changes, your sole recourse is to stop using the Site.
